Scope

These General Terms and Conditions apply to all business transactions between Wunderbaum Expert OG, Vereinsgasse 12/2-5, 1020 Wien (hereinafter referred to as „Wunderbaum Expert“ or „seller“) and its contractual partners (hereinafter referred to as „customers“ or „buyers“), in particular for orders placed in its online shop. Any deviations from these terms must be made in writing to be legally effective. The seller will not recognize any terms and conditions of the Customer unless the Seller expressly agrees to their validity in writing.

Conclusion of contract

By placing an order, the customer declares that they are at least 18 years old and that they will comply with the applicable legal regulations. All offers and promotions, particularly in advertising materials and in the online shop, merely constitute an invitation to the customer to submit (binding) offers/orders and are only valid while stocks last. Submitting an order in the online shop therefore constitutes a binding offer to conclude a purchase contract for the goods contained in the shopping cart. Wunderbaum Expert then has 7 days to accept the customer's offer by sending an order confirmation (via email). Wunderbaum Expert will then generally ship the order within 14 days. All prices are in euros and include statutory VAT, plus shipping costs will be invoiced. The prices are non-binding and subject to fluctuations. The exact sales price will be specified in detail in the order confirmation. The specific shipping costs to the delivery location will also be specified in detail in the order confirmation. Should the order confirmation result in a higher purchase price, the contract shall only be concluded upon payment by the customer.

Pay

Payment for goods is generally made in advance to the account number specified by Wunderbaum Expert. The purchase price, including all fees, is due upon receipt of the order confirmation and must be paid immediately to the specified account (exception: if the order confirmation contains a higher price than the online shop).

Transport

Delivery takes place by sending the purchased item to the address provided by the buyer. For deliveries against advance payment, the purchased item will be shipped upon receipt of the purchase price plus shipping costs. Wunderbaum Expert preferably delivers the purchased items via the Austrian Post or via an alternative delivery service. Wunderbaum Expert therefore has no influence on delivery times. The following applies to businesses: Transport damage and insurance depend on the parcel service; Wunderbaum Expert assumes no liability for this. Upon receipt of the delivery, check for any visible damage and report any such damage to the courier or refuse acceptance. Wunderbaum Expert will not accept a package accepted by the customer with obvious transport damage. Upon handover of the goods to the transport company, any risk for deterioration or loss of the goods is transferred to the customer.

Retention of title

The delivered goods remain the property of Wunderbaum Expert until full payment has been made. Prior to transfer of ownership, pledging, transfer by way of security, processing, or modification is not permitted without the express consent of Wunderbaum Expert. Asserting the retention of title shall only constitute a withdrawal from the contract if this is expressly declared. Wunderbaum Expert is entitled to charge any transport and handling costs incurred upon return of goods. In the event of third-party access to the reserved goods—in particular through seizure—the customer undertakes to point out Wunderbaum Expert ownership rights. Furthermore, the buyer shall immediately notify Wunderbaum Expert in writing of any legal impairment of the goods subject to retention of title by third parties.

Applicable law and jurisdiction agreement

For all legal transactions, Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Vienna is agreed as the place of jurisdiction. The place of performance for all contractual parties is also Vienna.

Severability clause

Should any provision of these Terms and Conditions be invalid or void, the remaining provisions shall remain in effect.
